Technically it does affect them, just not in a significant way.

Well, unless they want to make a Touhou 360 game or iPhone app.

I didn't have much to say about this initially especially since I know Sankaku likes to blow things way out of proportion, but ZUN recently made a new blog post clarifying a few things.

It's not even that big of a deal, and like I suspected it never meant the ban of Touhou porn. From what I can tell, what it really means is that doujins need to stay within legal bounds, so that his characters aren't subjected to extremities such as child porn for example. But even then, it still needs to be enforced to have any impact at all.
